Terms and Conditions

By booking a tour with ORKNEYiNGA TOURS, you are agreeing to the following terms and conditions.

Deposit and Payment

A 50% deposit (in Sterling) is required to secure your tour at time of booking. This deposit is non-refundable.

The remaining 50% balance payment (in Sterling) must be made at least 60 days before the commencement of the tour.

Bookings made within 60 days of the commencement of the tour must be paid in full at the time of booking.

Payment should be made by bank transfer.

If payment is not received within the timescale stated above, the booking will be cancelled.

Cancellation by Customer

Cancellations must be made by email.

Where a cancellation is received more than 30 days before commencement of the tour, and full payment has been made, a refund of the 50% balance payment will be given.

Where a cancellation is received less than 30 days before commencement of the tour, no refund will be given.

In the event of adverse weather, travel disruption or delay, personal circumstances or any other unforeseen circumstances which may result in customers being unable to attend their booked tour, ORKNEYiNGA TOURS will endeavour to delay or reschedule the tour. Where it is not possible for ORKNEYiNGA TOURS to do so, the booking will be deemed to be cancelled and the cancellation policy above will apply.

Cancellation by ORKNEYiNGA TOURS

Whilst every attempt is made to ensure that tours run, ORKNEYiNGA TOURS reserves the right to cancel a tour at any time prior to its commencement. In this case, customers will be entitled to a full refund of all payments made. If a tour requires to be cancelled by ORKNEYiNGA TOURS when it has been partially provided, the guest will be entitled to a pro-rata refund of all payments made.

ORKNEYiNGA TOURS is not responsible for any travel or accommodation costs incurred in relation to cancelled tours.

Itineraries

Whilst ORKNEYiNGA TOURS will do everything possible to provide the tour itinerary and services as planned, we reserve the right to alter itineraries. ORKNEYiNGA TOURS will advise you of any changes at the earliest possible opportunity.

Liability

ORKNEYiNGA TOURS accepts no liability for any loss, damage or injury to persons or property, from any cause whatsoever, in connection with your booked tour.

Customers should be aware that tours will involve gentle to moderate walking on a variety of terrains in changeable weather conditions. Customers should satisfy themselves that they are sufficiently fit, and in possession of the appropriate clothes, footwear and equipment. Many of the sites we visit are old. Customers enter all sites at their own risk.

Adequate travel insurance is a condition of your contract with ORKNEYiNGA TOURS. You must be satisfied that your insurance fully covers all your personal requirements including pre-existing medical conditions, cancellation charges, medical expenses and repatriation in the event of accident or illness. If you choose to travel without adequate insurance cover, we will not be liable for any losses, injuries or damage, howsoever arising.

Right to Refuse Service

ORKNEYiNGA TOURS reserves the right to refuse to carry any person whose conduct or manner is likely to cause offense or upset to other customers or the guide. We also reserve the right to refuse travel to any person who is experiencing medical symptoms likely to cause ill health to others. It is therefore vital that you ensure that you are fit to travel on the departure date.

Customers are expected to conduct themselves in an orderly and acceptable manner and not to disrupt the enjoyment of others. If in our opinion your behaviour, or that of any member of your party is causing or is likely to cause distress, danger, or annoyance, damage to property, or cause a delay or diversion to transportation, we reserve the right to terminate your booking with us immediately. In the event of such termination, our liability to you and/or your party will cease and you and/or your party will be required to leave your tour immediately. We will not have any further obligations to you and/or your party. No refunds will be made and we will not pay any expenses or costs incurred as a result of termination. You and/or your party may also be required to pay for loss and/or damage caused by your actions. Full payment for any such damage or losses must be paid directly.

Vehicle Occupancy

Children under 16 years old are very welcome on ORKNEYiNGA TOURS. They must be accompanied by an adult.

Customers with any additional support needs or disabilities should inform ORKNEYiNGA TOURS at the time of booking to assess the suitability of the tour. Reasonable adjustments and support will be made available where possible. Unfortunately, our vehicle is not able to accommodate a wheelchair.

Assistance dogs are welcome on our tours. No other animals are permitted.

Tours have no minimum number of customers and a maximum of seven.

Luggage is limited to one small bag per customer.

Food and drink are not to be consumed within the vehicle, with the exception of water.

Please advise ORKNEYiNGA TOURS of any allergies in advance of your tour. ORKNEYiNGA TOURS cannot be held responsible for any health issues or allergic reactions caused by exposure to foodstuff or other products carried on board the vehicle by customers.

Smoking and the use of electronic vapes is not permitted in or around the ORKNEYiNGA TOURS vehicle.

Data Protection

ORKNEYiNGA TOURS respects your privacy and is committed to protecting your personal data.

It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.

The personal data provided by customers of ORKNEYiNGA TOURS shall only be used for the purposes of the reservation of the required tours offered by us, and for conducting the required tours.

In accordance with GDPR requirements, you will also be requested to provide specific consent if you agree to ORKNEYiNGA TOURS holding your details on record for the purpose of receiving information regarding future tours and offers. It is possible to opt out of this at any time by contacting us at info@orkneyingatours.com, heading your e-mail ‘Withdrawal of Consent to Marketing’. A confirmatory e-mail will be forwarded to you at the time of removal of your details from our mailing list.
